5. Your Data and Content
You retain ownership of information and content you provide to BizPlode, including project names, website URLs, keywords, and business context information.
By using BizPlode, you grant BizPlode a limited, non-exclusive, royalty-free license to use, host, store, process, transmit, and display your information solely to operate, maintain, secure, and improve the service, and to provide the service to you. This includes transmitting your domain and keyword data to third-party providers (such as DataForSEO) as described in our Privacy Policy.
This license does not grant BizPlode ownership of your websites, your website content, or any other business assets.
6. BizPlode Intellectual Property
BizPlode and its licensors retain all rights to the BizPlode platform, including the software, interface, branding, methodologies, scoring systems, and underlying technology.
You may use the analyses, recommendations, and reports generated for your account for your own business and SEO purposes. You may not resell, sublicense, or redistribute BizPlode's platform or its outputs as a competing service.
7. Aggregated and De-Identified Data
BizPlode may use aggregated or de-identified information derived from platform usage to understand how the product is used, improve its functionality, develop new features, and measure service performance. Aggregated or de-identified data does not identify you individually and is not considered personal information for purposes of these Terms.
BizPlode does not use identifiable customer data to train third-party AI models.
8. Third-Party Data and Accuracy Limitations
BizPlode relies on data and services from external providers, including Google Search Console, DataForSEO, and public search results. BizPlode does not control these providers or the accuracy, completeness, or availability of their data.
Search ranking data, keyword metrics, competitor data, and AI visibility information provided by BizPlode:
- May be incomplete, delayed, or estimated
- May not reflect current live rankings or search engine behavior
- May change after collection due to updates from search engines or data providers
- May be temporarily unavailable when external providers experience outages
BizPlode provides this data as reported by third-party sources and makes no representation that it is complete or error-free.
9. No SEO Guarantee
BizPlode provides information, analysis, and recommendations to help you understand your website's search performance. BizPlode is an informational tool, not a professional consulting service.
BizPlode does not guarantee any specific outcome, including but not limited to:
- Search engine rankings or positions
- Organic search traffic levels
- AI search citation or visibility
- Leads, conversions, or revenue
- Any other business result
Search engines operate independently and rankings can change for reasons outside anyone's control. You remain responsible for all business and SEO decisions made using BizPlode's outputs.
10. Service Availability
BizPlode does not provide a service level agreement or uptime guarantee during Early Access. The service may be interrupted or unavailable due to:
- Scheduled or unscheduled maintenance
- Outages affecting our hosting provider (Railway) or data providers
- Technical issues, bugs, or infrastructure failures
- Security incidents or protective measures

We will make reasonable efforts to restore availability promptly when interruptions occur.

Where practicable and appropriate, we will notify you of the reason for any restriction or suspension.
You may request account closure or deletion at any time by contacting support@bizplode.com. There is currently no self-service account deletion feature within the application. Sections of these Terms that by their nature should survive termination will do so.
12. Disclaimers
To the maximum extent permitted by applicable law, BizPlode is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, or non-infringement.
BizPlode does not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components, or that the information provided will be accurate, complete, or current.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusions may not apply to you in full.
13. Limitation of Liability
To the maximum extent permitted by applicable law, BizPlode and its operators, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or related to your use of, or inability to use, the service — including loss of profits, loss of data, loss of goodwill, business interruption, or cost of substitute services — even if advised of the possibility of such damages.
To the maximum extent permitted by applicable law, BizPlode's total aggregate liability arising out of or related to these Terms or the service shall not exceed the greater of (a) the amount you paid BizPlode in the twelve months preceding the claim, or (b) one hundred U.S. dollars (USD $100.00). During Early Access, while no fees are charged, BizPlode's aggregate liability is limited to the maximum extent permitted by law.
These limitations apply to all causes of action, whether based in contract, tort, statute, or any other legal theory, and whether or not BizPlode has been advised of the possibility of such damages. Some jurisdictions do not allow limitations on liability for certain types of damages, so these limitations may not apply to you in full.
14. Indemnification
You agree to indemnify, defend, and hold harmless BizPlode and its operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of BizPlode in violation of these Terms
- Your violation of any applicable law or regulation
- Your infringement of any third-party right, including intellectual property or privacy rights
- Any content or information you submit to BizPlode that is false, misleading, or violates third-party rights
15. Governing Law
These Terms and any disputes arising out of or related to the service are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles.
Any legal action or proceeding arising under these Terms shall be brought in the courts of competent jurisdiction in the State of Florida, and you consent to personal jurisdiction and venue in such courts.
16. Changes to These Terms
We may update these Terms as BizPlode evolves. When we make material changes, we will update the effective date shown at the top of this page and, where appropriate, provide additional notice — for example, by a notice within the application or by email.
Your continued use of BizPlode after an updated version of the Terms takes effect constitutes acceptance of the revised Terms where permitted by applicable law. If you do not agree to the updated Terms, you should stop using BizPlode.
